Summary: This bill codifies into CO law what assistance and emotional support animals are, and clarifies that the mere presence of an ESA or AA does not constitute a direct threat to health, safety, or property. The bill also states that permitting an AA/ESA in housing is presumed to be a reasonable accommodation, and the complete prohibition of such animals in housing is presumed to be discriminatory.
CHC Position/Concerns: AMEND - The Colorado Housing Coalition is seeking to amend this bill as there is no allowance or guidance in this bill for a housing provider to request or review documentation, like there was in HUD guidance. There is also no allowance to disallow a specific animal with a history of aggression like there is in current law around property insurance providers and animals. Our requested amendments would put these guardrails in place to keep CO law in line with historic HUD guidance.
