Summary: This bill requires a landlord to include the lease, and ledger in the event of a demand for non-payment of rent, whenever a demand or notice is served or posted to a residential tenant. Additionally, when an eviction action is filed, the landlord must include any records in his/her possession that pertain to the violation or no-fault eviction. The bill also keeps all eviction records as suppressed court records, unless the eviction was for a substantial violation of the lease. The bill also requires that landlords provide a tenant at least one rent payment option that does not require the tenant to access on online portal or pay a transaction fee.
CHC Position/Concerns: OPPOSED - The Colorado Housing Coalition opposes this bill to suppress all eviction records. It’s important that housing providers be able to thoroughly screen any potential residents, including looking at any prior evictions that an applicant was a party to. This bill will only create more uncertainty in the rental housing sphere by not allowing housing providers to accurately screen their future residents. Additionally, the requirement that a lease be served or posted with each and every demand creates a new burden to solve a problem that has already been solved by Colorado law. Housing providers are already required to provide leases to residents, and posting them with a demand won’t prevent a resident from losing them between when the demand is filed and the case is heard by a judge.
